PERMITS

 

New Hampshire Law provides that the N.H. Department of Environmental Services Wetlands Bureau is the regulatory authority of, "wherever the tide ebbs and flows and including the portion of any bank or shore which borders such surface waters."  The law also states that "no person shall excavate, remove, fill, dredge or construct any structures in or on any bank, flats, marsh, or swamp in and adjacent to any waters of the state without a permit from the department."

The end result is that a permit is needed for any repair of existing structures which requires work in the water, or for any new construction.  These projects include docks, (seasonal or permanent), boathouses, breakwaters, tie-off piling, ice-cluster, perched beaches and beach replenishment, shoreline stabilization, (vegetative, rip-rap & retaining walls), dredging projects and others.

Applying for a N.H. DES Wetlands Bureau permit can be done by the owner or an authorized agent.  The applicant needs to fill out the application form completely and accurately, including all attachments and plans as required by RSA 482-A and the N.H DES. Wetlands Bureau Code of Administrative Rules.
